Trieste legal action on taxation: the Court decides to not decide, appeal in second instance announced

Trieste, 29 September 2018 – Dr. Anna L. Fanelli, the judge the Court of Trieste appointed to decide about legal action 1757/2017, with which the International Provisional Representative of the Free Territory of Trieste – I.P.R. F.T.T. and 599 citizens and enterprises request to ascertain the system of taxation applicable in Trieste, has lodged the first instance judgment.

The 600 appellants have indeed requested to verify if the legislation in force allows the Italian Government «to establish and collect taxes or other fiscal revenues in the present-day Free Territory of Trieste in the name and on behalf of its administration, sub-entrusted to it, or in the name and on behalf of the Italian Republic». Economically, it is an extremely relevant difference.

The Court did not contradict the appellants. Instead, it decided to take no decision, declaring the lawsuit inadmissible on grounds that the I.P.R. F.T.T. defines «inconclusive» announcing «an immediate and easy appeal, consolidated by the fact that the Court avoided to express itself in the merit, and also by new, parallel legal actions, because the law is on our side.»
